Use of JWU Connect – Alumni Platform (network.jwu.edu)

Terms and Conditions

Johnson & Wales University (“JWU,” “the university,” “we,” “us,” “our”), provides access to JWU Connect (network.jwu.edu) and any subdomains (collectively, “Site”) subject to your acceptance of these Terms and Conditions (“Terms”). Any person accessing, browsing, and otherwise using the Site, either manually or via an automated device, shall be deemed a “User.” All Users are subject to and agree to be bound by these Terms when using the Site.

When using a particular feature of the Site, you may also be subject to any posted guidelines, privacy policies, rules, or terms of service. In the event of a conflict between any such posted guidelines, privacy policies, rules, or terms of service and these Terms, the provisions of these Terms shall govern when using the Site. JWU Connect is governed by the same terms and conditions as the jwu.edu domain‘’, including its acceptable use policy, which can be found in full at: https://www.jwu.edu/about-jwu/terms-of-use.html, and is incorporated by reference herein. Information specific to the JWU Connect site can be found below.

Service Provider
The Site is operated by our supplier Aluminati Network Group Ltd of Hyperion House (First Floor), The Oaks, Fordham Road, Newmarket, Suffolk, CB8 7XN. Aluminati will process personal data strictly for the purposes of operating this service.

Aluminati is registered with the Information Commissioner under membership number Z8393842.

Information About You and Your Visits to the Site

We process information about you in accordance with our Privacy Policy and Privacy Notice, available at https://www.jwu.edu/about-jwu/terms-of-use.html which both form part of these conditions and are incorporated by reference herein. Aluminati also processes information for the sole purpose of managing the JWU Connect website. By using the Site, you consent to all such processing and warrant that all data you provide is true and accurate.

Accessing the Site
Your user password and any other piece of information provided as part of our security procedures is confidential. You must not disclose it to any third party. 

You are responsible for making all arrangements necessary for you to have access to the Site.  You are also responsible for ensuring that all persons who access the Site through your internet connection are aware of these Terms and comply with them. Access to the Site is always at the university’s discretion and the university may withdraw or amend the services provided on the Site without notice. From time to time the university may restrict access to some or all users to some or all parts of the Site, and sometimes the Site may be unavailable. You use the Site and the internet in general at your own risk. We use reasonable efforts to ensure the continuous operation and availability of the Site and we use technologies to keep users’ data safe and accurate, but we cannot and do not guarantee these things.  Where possible, we will post advance notice on the Site where downtime is scheduled for maintenance. You should take appropriate precautions, including maintaining backup copies of any important data. Although the university aims to update the Site regularly, the content on the Site may be out of date at any given time.

If the university determines that you have breached any applicable term or condition or regulation or law, it may take such action as it deems appropriate, including disabling your password whether chosen by you or allocated by us.

Our Liability

Material posted on the Site, including material posted by you or other users or Aluminati, is not intended and does not amount to advice on which reliance may be placed.

Material is provided on an ‘AS IS’ and ‘AS AVAILABLE’ basis. To the extent permitted by law, the university excludes any representations or any warranties (whether express or implied by law), including as to satisfactory quality, fitness of a particular purpose, non-infringement, compatibility, security, accuracy or the reliability of the Site. This exclusion also applies to and for the benefit of Aluminati.

Neither the university nor Aluminati will be liable to you or any party for any of the following losses or damage even if the losses were reasonably foreseeable to both you and us when you began using the Site: (i) loss of anticipated profits, business, data, goodwill, opportunities, revenue; (ii)  (iii) loss suffered by third parties, or (iv) any consequential, direct, incidental, indirect, or special damages arising out of use of the Site or reliance on any material or services provided in the Site or accessed through it, whether or not amended by third parties and regardless of form of action and whether or not resulting from either of us breaching these conditions or from disruption, discontinuation or unavailability of the Site at any time.

Trademarks
The name and shield of the Johnson & Wales University are trademarks. The word mark “JWU” is registered with the United States Patent and Trademark Office (USPTO) (Registration Number 6264337). Violating these trademarks and copyright laws can result in disciplinary or legal consequences. 

Governing Law; Choice of Forum

These Terms and access to the Site shall be governed by and construed in accordance with the laws of the State of Rhode Island, exclusive of its conflict of law rules, and, where applicable, the federal laws of the United States of America.

Except insofar as binding arbitration is required under the Website User Agreement, you hereby irrevocably and unconditionally consent to submit to the exclusive jurisdiction of the State of Rhode Island in the United States of America for any dispute resolution arising out of or relating to use of the Site, and you agree not to commence any proceeding relating thereto except in the State of Rhode Island in the United States of America.

General
If you breach these conditions and we take no action, we will still be entitled to use our respective rights and remedies in any other situation where you breach these conditions.
